Christopher Richter, a partner in the firm since 2004, is considered a “litigation star” by Benchmark Canada in the fields of commercial litigation, class actions, securities litigation, and arbitration. Chambers Global also mentions his experience in domestic and international disputes and in the areas of professional liability, product liability and employment law. Christopher has been practicing in the fields of civil, corporate and commercial litigation since 1996. He has appeared before the Quebec courts of first instance and of appeal, the Federal Court and Federal Court of Appeal, the Ontario Superior Court, and the Supreme Court of Canada, as well as numerous administrative tribunals and arbitration panels. He has also acted as arbitrator in numerous disputes (sole arbitrator, or member or chair of a panel), both domestic and international (including ICC and ICDR arbitrations). He has an interest and significant expertise in matters of private international law. He taught civil procedure at both McGill University and the Université de Montréal. Active for many years in the Canadian Bar Association,  Christopher was Quebec branch chair of the International Law Section and chair of the Business Dispute Resolution Committee of the National ILS.  He is also active in the Litigation Committee of the International Bar Association. Other memberships include The London Court of International Arbitration, The University Club Of Montreal and the Club Sportif MAA.

// REPRESENTATIVE MANDATES

Acts for Rothmans, Benson & Hedges Inc. in defense of a $60 billion claim by the Province of Quebec against various tobacco manufacturers under the Tobacco-Related Damages and Health Care Costs Recovery Act.

Has represented Costco Wholesale Canada Ltd. at the hearings of the Régie de l’énergie (Quebec Energy Board)every three (3) years since 2001 to determine the amount of deemed operating costs which may be included in the estimated minimum price of gasoline sold by retailers in Quebec.  Also represented Costco in the hearings of applications to include that amount in the estimated minimum price, and related review hearings (both administrative and judicial).  

Defended TE Connectivity Ltd. (formerly Tyco Electronics Corporation) against allegations of product defect regarding electronic components, in McKesson Canada Corporation, et al. v. Tyco Electronics Corporation, et al. (S.C.M. 500-17-055247-095).

Represented Ticketmaster Canada and related entities in a class action alleging violation of the Consumer Protection Act by misleading and false representations in the secondary market for event tickets, in D’Urzo v. Tnow Entertainment Group Inc., 2012 QCCS 3820.

Appeared on behalf of Fairfax Financial in the proceedings before the Bureau de décision et de révision en valeurs mobilières concerning the hostile takeover of Fibrek Inc.

Successfully contested authorization of a class action alleging that a ship-owner could be held liable to the users of a bridge closed following a maritime incident, in Labonté v. Voyageur Marine Transport Ltd., 2011 QCCS 2196, J.E. 2011-1070, and maintained that result in appeal, 2012 QCCA 1940, J.E. 2012-2174.

Obtained a provisional injunction and safeguard order on behalf of a securities firm against a departed advisor, in Valeurs mobilières Desjardins inc. v. Lambert, 2009 QCCS 4278, J.E. 2009-1907.

Successfully invoked State immunity to dismiss the claim against our client, in New Jersey (Department of the Treasury of the State of) v. Trudel & Johnston, 2009 QCCA 86, [2009] R.J.Q. 46.

Represented the Ontario Teachers’ Pension Plan and the other private equity Purchaser Parties to successfully contest the arguments of bondholders challenging the approval of one of the largest proposed leveraged buy-outs in history, from first instance to the Supreme Court of Canada in BCE Inc. v. 1976 Debentureholders, 2008 SCC  69, [2008] 3 S.C.R. 560; and in the subsequent contractual dispute between the Purchaser Parties and BCE Inc.

Successfully contested authorization of a product liability class action in the automobile industry and maintained that result in appeal, in Del Guidice v. Honda Canada Inc., 2007 QCCA 922, [2007] R.J.Q. 1496.

Successfully appealed the dismissal of a declinatory motion contesting the jurisdiction of the Quebec courts, in Shamji v. Tajdin, 2006 QCCA 314, J.E. 2006-625.

Successfully argued in favour of the application of the implied undertaking of confidentiality to discovery proceedings in Quebec at the Supreme Court of Canada, in Lac d’Amiante du Québec, ltée v. 2858-0702 Québec inc., 2001 SCC 51, [2001] 2 S.C.R. 743.
